Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and Hanzi Calligraphy (“we,” “us,” or “our”) governing your use of the Hanzi Calligraphy mobile application and related services (the “app”). By downloading, accessing, or using the app you agree to these Terms. If you do not agree, do not use the app.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial learning, subject to these Terms and the app store rules that apply to your device. For the app obtained from the Apple App Store, this license is limited to use on any Apple-branded products that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

2. Accounts

You must provide accurate information when creating an account and are responsible for keeping your credentials secure and for activity that occurs under your account. You must be old enough to form a binding contract in your jurisdiction to use the app.

3. Subscriptions and billing

• The app offers a free tier and a paid Hanzi Master subscription, available as a monthly or yearly plan.
• Subscriptions are sold and billed through your Apple App Store or Google Play account. Payment is charged to that account at confirmation of purchase.
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the period.
• You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Deleting the app or your Hanzi Calligraphy account does not cancel a subscription.
• Except where required by law or the applicable app store’s policies, payments are non-refundable. Refund requests are handled by Apple or Google under their terms.

4. Acceptable use

You agree not to:

• reverse engineer, decompile, or attempt to extract the source code of the app, except where permitted by law;
• copy, resell, sublicense, or commercially exploit the app or its content;
• interfere with, disrupt, or attempt to gain unauthorized access to the app or its systems;
• use the app in any unlawful manner or in violation of these Terms.

5. Intellectual property

The app and its content — including lessons, text, artwork, fonts, software, and the Hanzi Calligraphy name and marks — are owned by us or our licensors and are protected by intellectual-property laws. Nothing in these Terms transfers any such rights to you.

6. Disclaimers

The app is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that content is accurate or complete.

7. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the amount you paid us for the app in the twelve months before the claim.

8. Termination

You may stop using the app and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Provisions that by their nature should survive termination will survive.

9. Governing law

These Terms are governed by the laws of the United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts located in the United States, unless otherwise required by applicable law.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of the app after changes take effect constitutes acceptance of the revised Terms. Material changes will be reflected by updating the “Last updated” date above.

11. Additional terms for Apple App Store downloads

If you download the app from the Apple App Store, the following terms also apply. Your use is likewise subject to Apple’s Licensed Application End User License Agreement (standard EULA); where these Terms conflict with that EULA, the EULA governs for App Store downloads.

• Acknowledgment. These Terms are between you and Hanzi Calligraphy only, and not with Apple. Hanzi Calligraphy, not Apple, is solely responsible for the app and its content.
• Scope of license. The license granted to you is as described in Section 1 above and is limited to use on Apple-branded products you own or control, per Apple’s Usage Rules.
• Maintenance and support. Hanzi Calligraphy is solely responsible for providing any maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services.
• Warranty. Hanzi Calligraphy is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app; to the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the app.
• Product claims. Hanzi Calligraphy, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession and/or use of it, including product-liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection, privacy, or similar laws.
• Intellectual property. In the event of any third-party claim that the app or your possession and use of it infringes that third party’s intellectual-property rights, Hanzi Calligraphy, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
• Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist-supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Developer contact. Direct any questions, complaints, or claims regarding the app to Hanzi Calligraphy at admin@hanzi-calligraphy.app.
• Third-party terms. You must comply with any applicable third-party terms of agreement when using the app (for example, your wireless carrier or data-plan terms).
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple will have the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
